Role of the Regulator and Enforcement Mechanisms

The Nevis Online Gaming Ordinance, 2025 provides the Nevis Gaming Authority with robust tools to ensure a well-regulated, secure, and trustworthy online gaming industry. At the heart of this oversight framework is the appointment of a Regulator, tasked with supervising licensees and ensuring full compliance with the law.

The Role of the Regulator

Under Section 35 of the Ordinance, the Authority appoints a dedicated Regulator responsible for:

  • Supervising and reviewing the operations of all licensees;

  • Conducting inspections and examinations;

  • Investigating potential breaches of the Ordinance;

  • Reviewing applications and making compliance recommendations to the Authority.

The Regulator serves as the operational extension of the Authority, empowered to act independently in conducting both on-site and off-site supervision of licensees.

Inspection and Supervision Powers

The Ordinance authorizes the Regulator to carry out regular and unannounced inspections of licensees. These inspections may include:

  • Access to books, records, systems, and financial documents;

  • Interviews with management and staff;

  • Requests for data to assess compliance with AML/CFT obligations.

Licensees must respond promptly to all requests and may submit documentation electronically or in hard copy. Failure to cooperate may result in administrative penalties.

Enforcement Tools Available to the Authority

To enforce compliance, the Authority is empowered to recommend the following actions to the Minister:

  • Restriction of Licence – New or additional conditions imposed on the licensee.

  • Suspension of Licence – Temporarily halting operations in cases of urgent public risk or legal breaches.

  • Revocation of Licence – Complete cancellation in cases of misconduct, inaction, or failure to comply with key requirements.

Additionally, unauthorized operations—such as offering online gaming services without a licence—may result in legal action, seizure of assets, and criminal penalties.

Safeguards and Legal Recourse

All enforcement actions are subject to procedural safeguards. Licensees are entitled to:

  • Receive written notice and reasons for enforcement actions;

  • File objections or appeals with the Appeals Tribunal;

  • Further appeal decisions to the courts if necessary.

This framework ensures that regulatory enforcement is both effective and fair.
